COURSE OF STUDY, GRADED

Boards of exempted village, city districts, and governing boards of ESCs shall prescribe a graded course of study. Required subjects are described in this statute. Any school district shall permit the parent of a child to “promptly” examine (with regard to that parent’s child) any of the following: any survey or questionnaire (prior to its administration); any instructional materials being used by the district for that child; any completed and graded test or survey or questionnaire completed by the child; and copies of the statewide academic standards and model curricula. Copies of the academic standards and model curricula “shall be available at all times during school hours in each district school building.” By a majority vote of its entire membership, the state board of education may propose the creation of a new local school district from one or more local school districts (or parts of districts). At its next meeting (held not earlier than 30 days after the adoption of the initial resolution), the state board may adopt a resolution making the creation effective on the next succeeding July 1. However, if 35% of the number of qualified electors who voted in the last general election and who reside within the territory of the district to be created file a petition of referendum against the new district’s creation, the issue will be decided by the voters of the district to be created. The question will be submitted to electors at the next general or primary election occurring not less than 90 days after the petition is certified to the board of elections (or at a special election specified in the certification of the petition). If a majority of voters approve the creation of the new district, the state board shall then create the district prior to the next succeeding first day of July. The indebtedness of each former district is assumed in its entirety by the newly created district. (If only parts of districts were used in the creation of the new district, then a pro rated share of the debt becomes assumed by the newly created district.) If the territory of a newly created local district lies within the territory of more than one educational service center, the state board of education shall determine the ESC to which the new district is assigned. The basic state funding for the new district shall not be less in any of the next three fiscal years than the amount (or prorated amounts) received by the districts separately in the year in which the new district was created. However, the Ohio General Assembly has added an additional step to this process. Any new school district created by the state board of education after the 2004-2005 school year must also be approved through passage of a concurrent resolution by both chambers of the General Assembly. A new school district can be formed from non-contiguous territory if the board of education having territory separating the territory of the proposed new district adopts a resolution approving the establishment of the new district.
