indebtedness under Sections 133.04 and 133.042 cannot exceed one percent of the total value of all property.

Boards may not submit bond issues which will make the net indebtedness higher than 4 percent of the assessed valuation without securing the consent of the tax commissioner and the superintendent of public instruction acting under the policies adopted by the State Board of Education. If the voters do not approve the bond issue, the district need not submit an application to the superintendent of public instruction and tax commissioner for permission to exceed the 4% of its taxable valuation if the issue is submitted at the next possible special election (which is defined in ORC 3501.01). Exceptions are provided for special needs districts (which are experiencing rapid enrollment growth) and districts whose facilities have been destroyed or condemned. The 9% limit may also be exceeded for the school district share of an Ohio Construction Facilities Commission (OCFC)project. The limit can be exceeded for: OCFC required locally funded initiatives; the cost of site acquisition; and other locally funded initiatives so long as they do not exceed 50% of the basic project cost. The OCFC must notify the superintendent of public instruction that the district is exceeding this limit. Boards may appoint, remove, transfer, lay-off, suspend, reinstate, promote, or reduce in status non-certificated personnel in accordance with civil service regulations for city districts. If the city has a charter, the charter may specify alternatives. While a non-civil service board of education may not terminate a contract except for certain specific reasons, an exception is provided for terminating the contracts of transportation staff if the board enters into a contract for transportation services with an “independent agent.” The action can either be authorized by a collective bargaining agreement or be implemented by the board of education if the current collective bargaining agreement has expired or will expire within sixty days. However, employees retain some rights regarding their employment and representation should the board of education authorize this option. Students enrolled in chartered or non-chartered nonpublic schools must be permitted to participate in an extracurricular activity at the school of the student's resident school district to which the student would otherwise be assigned. The superintendent of a school district is permitted, but not required, to allow any student who is enrolled in a nonpublic school and is not entitled to attend school in that district to participate in a school's extracurricular activities if: (1) the nonpublic school in which the student is enrolled does not offer the extracurricular activity, and (2) the extracurricular activity is not interscholastic athletics or interscholastic contests or competition in music, drama, or forensics. The net indebtedness of a school district may not exceed 9 percent of its assessed valuation. For those districts for which Sections 124.01 through 124.99 of the Revised Code do not apply, the provisions of this section shall apply for the employment of non-certificated personnel.
