However, no decision to terminate or nonrenew a teacher’s contract are to be made solely on the basis of the results of the examination until and unless the teacher has not attained a passing score on the required exam for at least three consecutive administrations of the exam.

The board of education and other political subdivisions are prohibited from taxing property more than 10 mills for each dollar of valuation in any one year without the consent of the voters. These are normally called un-voted, or inside, mills. Board members’ terms begin on January 1 after their election and continue for four years, expiring December 31. Board elections are held during the General Election in odd-numbered years. See also VACANCIES – BOARD OF EDUCATION below. Generally speaking, the annexation of territory into a city or village does not automatically transfer the same territory into the city school district or the school district of which the village is a part. Any such territorial transfer must be approved by the state board of education. One exception is when all of the territory of a school district is annexed into a city or village. In that case, the annexed school district becomes part of the city school district or the school district of which the village is a part. Another exception is when the annexation involves an urban city school district (which is defined in law as a city school district with an average daily membership for the 1985-86 school year in excess of 20,000 students). In that case, any annexation agreement approved by the affected boards of education will control the district in which the annexed territory belongs. The transfer of all or part of the territory of a local school district to adjoining local districts or one adjoining local district can be initiated by the governing board of the local district’s educational service center so long as all involved districts are located within the territory of that ESC. The transfer of the territory can then be approved at the next regular meeting of the ESC governing board held at least 30 days after approval of the initial resolution on the transfer. However, if a petition of referendum signed by a majority of the electors voting in the last general election and residing in the affected area is filed with the ESC superintendent, the issue will be presented to voters at a subsequent primary or general election (held at least 90 days after the filing of the petition) or at a special election specified in the petition. A transfer can also be initiated by a petition signed by 55% of the qualified electors voting in the last general election and residing in the territory proposed for transfer. The vote on this petition of transfer follows the same procedures as the petition of referendum. A transfer of territory is subject to the approval of the receiving board(s) of education unless the transfer is made by the ESC governing board. If the receiving board objects, it must appeal to the state board of education which either accepts or rejects the transfer.

If an entire school district is proposed to be transferred to two or more districts, the rejection of the transfer by one of the receiving boards of
